Thai cabinet committee approves in proposal of legalizing private passenger vehicles for public transportation in service applications

Transport Minister Saksiam Chidchob revealed today, May 25th, that the cabinet committee has approved of an initial resolution of legalizing private passenger vehicles for public transportation licensed in transportation applications in Thailand.

The approval will allow people who have personal cars and want to use them as a public vehicle to register and use their vehicles as public transport under the supervision of the Department of Land Transport in order to legally provide services to passengers through applications, the Minister stated.

“The Department of Land Transport will issue a notice stipulating the criteria, conditions, and certification to service providers and service applications. All opinions and ideas of relevant private service sectors will be considered to be prescripted in the draft of the law. The process of law implementation will take about 30 days to be published in the next Government Gazette,” he added.

Regarding the registration, an applying vehicle for service must be no older than 9 years. The size of the vehicle is divided into 3 categories: Small vehicles (50 to 90 kW) such as a Nisson March, Toyota Vios, Honda City, Nisson Mirage, etc.; Medium vehicles (90 to 120 kW) such as a Toyota Altis, Honda Civic, etc.; and Large cars (more than 120 kW) such as a Honda Accord, Toyota Fortuner, etc.

Drivers must hold a public driving license and pass a criminal background check from the Royal Thai Police. They must apply and pass identity authentication from certain authorized service applications, such as a pin code, fingerprint, face scan, etc. prior to any service operation.

Service applications must be registered as a juristic person in Thailand and have funding of not less than 5 million baht for registration as specified in the law. The company must have a business location in Thailand, have the availability of services for 24 hours a day, and must never have been revoked from a GPS service provider under the law of the Department of Land Transport.

TPN media notes this is a big step forward for the legalization of widely accepted and used delivery and transportation mobile application tools that are technically illegal. However, they have significant pushback and opposition by organized taxi companies and motorbike taxi groups, who have yet to officially comment on today’s proposal approval.
