Thai Constitutional Court Rules Insufficient Evidence in Thaksin Hospitalization Case

On December 18th, 2024, the Thai Constitutional Court dismissed a petition filed by Mr. Kongdecha Chairat, who alleged that the Minister of Justice (Respondent 1), the Director-General of the Department of Corrections (Respondent 2), and the Warden of the Bangkok Remand Prison (Respondent 3) acted unlawfully in granting former Thai PM Thaksin Shinawatra medical treatment privileges outside of prison.

The petition argued that the 2020 ministerial regulation used to transfer Thaksin to a private room on the 14th floor of the Police General Hospital lacked proper justification and evidence of severe illness.

It further claimed that this act violated constitutional equality under Section 27 by granting Thaksin preferential treatment over other inmates, undermining judicial sovereignty, and violating Section 49 of the Constitution regarding attempts to overthrow the democratic system under the monarchy.

After deliberation, the Constitutional Court ruled that the allegations lacked sufficient evidence or clarity to substantiate claims of unconstitutional actions. As a result, the court unanimously declined to accept the petition for further consideration.
